These Terms govern the use of the visual novel creation and sharing platform provided by Frivino (hereinafter 'the Service'), defining the rights, obligations, and responsibilities between the Service and the user. By signing up or using the Service, you are deemed to have agreed to these Terms.
Article 1 (Purpose and Application)
These Terms aim to clarify the necessary matters for users to create and share creative works on the infrastructure operated by a solo developer for non-profit or profit-making purposes, thereby protecting the legal rights of both the Service and the user.
Article 2 (Definition of Terms)
- User (Member): A person who accesses the Service, creates an account, and uses the Service in accordance with these Terms.
- Content: All forms of information and creative works, such as text, images, sounds, scenarios, and scripts, posted, uploaded, or shared by the user within the Service.
- Platform: The entire system and web environment provided by the Service so that content can be produced and shared with others.
Article 3 (Effect and Modification of Terms)
① The Service shall post the contents of these Terms on the initial or connected screen of the Service so that users can easily find them.
② The Service may amend these Terms within the scope not violating relevant laws, and shall notify users of such amendments at least 7 days prior to the effective date via in-service announcements.
Article 4 (Membership and Account Management)
① Users create accounts through social login. Usage may be restricted if one signs up by stealing another person's name or identification.
② Responsibility for account management lies entirely with the user, and the Service is not liable for any disadvantages arising from negligence in management.
Article 5 (Copyright and Usage Rights of Content)
The following is stipulated to clarify legal rights to the content created by users:
1. Ownership of Copyright: The copyright of all content posted within the Service belongs to the user themselves who created and uploaded it.
2. License Grant for Platform Use: By posting content, the user is deemed to have granted the Service a worldwide, non-exclusive, royalty-free license to display, distribute, promote, and transmit such content within the Service.
※ Users must guarantee that their content does not infringe on the intellectual property rights of others (copyright, trademark, etc.), and all legal liability arising from infringement lies with the user.
Article 6 (Prohibited Acts & Clean Platform Policy)
Users shall not engage in the following acts. Frivino aims for a clean creative environment that can be enjoyed by all ages.
- Unauthorized theft or reproduction of others' works (illustrations, BGM, text, etc.)
- Posting content that harms public order and morals, including obscene, violent, or discriminatory content
- Defaming or insulting others
- Interfering with system operation or attempting to hack the Service
Article 7 (Exemption and Limitation of Liability)
As a platform operated in a solo development environment, the Service is not legally liable for the following:
① Intermediary Status: The Service only provides the space (infrastructure). It has no legal obligation to pre-inspect or monitor all content.
② Non-intervention in Disputes: The Service is not obligated to intervene in civil or criminal disputes between users or third parties regarding copyright, and is not liable for damages.
③ Data Loss: The Service is not liable for the loss or damage of user data due to natural disasters, server failures, etc. Personal backups are strongly encouraged.
Article 8 (Changes and Operation of Service)
① The operator may modify, add, or suspend all or part of the Service at any time for maintenance and improvement.
② The continuity of the Service is not guaranteed. If the Service is terminated, notice will be given at least 30 days in advance.
Article 9 (Advertisements and Monetization)
① The operator may display advertisements within the Service for its maintenance, and users agree to this.
② Regulations for future paid features will be provided through separate operating policies.
Article 10 (Governing Law and Jurisdiction)
① All disputes shall be governed by the laws of the Republic of Korea.
② Lawsuits shall be filed with the court having jurisdiction over the operator's location.
